I'm surprised that Tom Sawyer Diner made the exception list. Of course I haven't been there in years. But I find it hard to believe that they make more money from alcohol than food. Looks like they have quite an extensive menu. Do you know what the ration is supposed to be?

I'm not surprised at all. Actually, I'm surprised they serve ANY food. Plus, they're no longer a diner; it's a Mexican "cantina" now. Weekends, they're always having big parties, and when you're selling 2 for $1 tacos - it's easy to see how booze definitely outweighs food.

Food sales have to be 20 percent or less of your total revenue in order to qualify.

Surprises...

No Dragonfly? Maybe they got snagged by the nightclub rule...

Max's/Sam Bucca's? Never been to it as Sam Bucca's but I thought I remembered them being smoke-free as Max's...

No Tara Station? I have not been there in a while, but I assumed they'd be going for an exception.

No Ceolta's? I thought they had an exception for the downstairs.

No Club 1400? They've got signs up saying smoking is permitted.

I'm sure there are others...

We were discussing some missing spots on Twitter this a.m. I think these are the ones whose exemptions have been APPROVED, meaning it is not a final list, as other applications are pending.

Sam Bucca's was never non-smoking, but Carmella's, which preceded it, went non-smoking a few months before it closed.
